I. GUARANTEE CONDITIONS.

1. BLUE FACTORY TEAM SMLLC products are sold exclusively to the authorised distributor network, who make their assembly and maintenance.

2. BLUE FACTORY TEAM SMLLC products are manufactured following the most innovative production methods, as well as the most demanding quality controls.

3. BLUE FACTORY TEAM SMLLC keeps the right to repair or replace the total of the faulty product, or the specific faulty piece based on the technical service assessment.

4. The products or pieces subject to changes due to reasons included in the guarantee, will be replaced for one of the same model or and equivalent.

5. All the guaranty must be processed through an authorised BLUE FACTORY TEAM SMLLC distributor, and it is necessary to present the purchase receipt and the web register. The point of sale will follow the guarantee processing pattern defined by BLUE FACTORY TEAM SMLLC.

II. GUARANTEE EXCLUSIONS

1. Usual wear by use of products.

2. Inappropriate assembly or maintenance, as well as non-compatible installation of pieces and accessories or which do not suit the specific use conditions.

3. This guarantee is limited only and exclusively to the repair or replacement of a faulty product and does not cover in any case the personal damages that may derive in a direct or indirect way from a mistake of such during their use.

4. Damages or failures cause by accident, inappropriate use, abuse or negligence.

5. Every product has a life cycle that will vary depending on the kind of material and its construction. Such life cycle may be shortened due to the kind of use, or the lack of maintenance and appropriate care. For this reason, the guarantee will depend fully on the optimum life cycle determined by BLUE FACTORY TEAM SMLLC, for each product in particular.

6. Every product is manufactured to develop a kind of use according to its technical features. The guarantee will be valid as long as it has been given the use it has been made for.

7. Labour for the replacement or substitution of pieces.

8. All the guarantee will be subject to our technician’s decision on the origin and causes of the break, after a deep study of the product in in question.

9. The guarantee length and details may vary depending on the country where the product is acquired, being it subject to legal conditions and specific limitations of the country in question.

III. DISPUTE RESOLUTION AND SETTING THE ENFORCEABLE LAW.

In the event of disagreement on the validity, execution or interpretation of this Contract, the parties commit to settle it in a friendly way. Nevertheless, in the event that the parties do not reach an agreement through negotiation, the parts involved agree that every dispute, disagreement, matter or claim originating from the execution or interpretation of this or any related contracts, in a direct or indirect way, will be definitely settled by arbitrage, in the context of the Alicante Arbitrage Court (Spain) located in the Official Chamber of Commerce, Industry and Navigation in Alicante (Spain), responsible for managing the arbitration and assignment or arbitrators, according to its Regulations and Statutes, which it will settle enforcing the Spanish Law.

IV. PROTECTION OF PERSONAL INFORMATION.

BLUE FACTORY TEAM SMLLC, in compliance with the Spanish Law 34/2002, 11th July, of information society and digital commercial service, and with the Spanish Organic law 15/1999, 13th December, of Protection of Personal Information, notifies you that your personal information will be included in files owned by BLUE FACTORY TEAM SMLLC, aimed at managing suppliers, customs, performing the services hired and other commercial actions. Such information can be transferred by BLUE FACTORY TEAM SMLLC to third parties, only and exclusively in the case of having to deal with a claim derived from the infringement of industrial and intellectual property rights by part of the buyer.
